I have my auto loan and bank account through the same credit union. My bank account was closed years ago at the discretion of the credit union bc i never used it, BUT i did have a $500 loan connected with that bank account. I thought i had paid it back way back when and never heard anything else about it from the credit union or collections department. My auto loan is current in payments.
My car was repoed yesterday. The lady from the assets and collections department said she had no idea that it was going to get repoed, but found out that her boss put my car on the list because of that 500 loan from my bank account.
is that legal for them to do? I am 4 months away from owning that car and now because of that 500 loan I probably wont be getting my car back because of all the extremely high towing and storage fees. any advice??Can my car get repoed for this?
They should have been sending you notices in the mail that your loan payments were late. Find out if they sent them to the wrong address or something. You can convince them to give your car back and let you pay off the loan now, on the grounds that you weren't notified. Hopefully you won't need a lawyer.Can my car get repoed for this?
The status of a previous loan should not have any effect on your current loan, as long as you are up to date and on time with your payments. They may be in violation of their own loan contract, but credit unions operate under a different set of rules than banks do. I'd double check with the credit union to be sure why the car was repossessed, and then go talk to a lawyer.
